ODKay is a social media platform where you can connect with artists, music producers, photographers, and many other content creators. These terms are to protect each and every user on the site as well as ODKay as a company. Our site is free for supporters to sign up but is $5 USD for content creators, which is paid upfront and only required before creating a content creator account. In addition, if you would like to support us and our development, you may join the “ODKrew” which is a monthly subscription of $5 USD indefinitely until cancelled by the user.
Section I (Services We Offer)
We offer beat production! Are you an inspiring artist looking to get started and make a name for yourself? Or maybe an already acclaimed artist looking for a cheaper or more reliable solution? That’s where we come in. We will produce any beat requested, in accordance with our pricing (Section II), custom to each customer’s request.
Maybe you already have a beat and you would like us to write some lyrics to go with your beat. Or maybe you have neither and would like us to write the lyrics and produce the beat. That’s fine too! ODKay has a select group of professional and experienced song writers that will write you a custom song according to your request and in compliance with our pricing as shown in (Section II).
Audio mixing creates the sound the artist is trying to project perfectly with specific plugins and enabling the producer to correct every detail of each individual audio wav file. Dry Vocals? No worries, we have mixing engineers ready to dedicate the effort needed to get your vocals sounding radio ready in accordance with our pricing (Section II).
Audio Mastering is the final works of any song. Every audio file from kicks and snares to vocals and ad-libs all will play an important role in how the song sounds so our engineers will focus on the positioning and volume of each sound to ensure that everything is correctly formed together in accordance with our pricing (Section II).
Have a video that needs editing? Send it to us and we will edit your video as specified by you. This will correspond with our pricing as in (Section II) We will edit any video you send us such as YouTube videos, gaming montages, music videos, etc.
In need of some professional pictures for a company, wedding, graduation, etc.? Let us know and we will have someone in your local area schedule a time and date at your desired location. Our pricing will apply as you will pay us directly. There will be no hidden fees or anything paid directly to the photographer (we take care of this for you). Our pricing can be found in (section II).

Section III (Energy & Pricing)
We use a unique currency that can only be used throughout our platform. This currency is called “Energy”. Energy can be obtained by either purchasing it or by earning it through various ways, such as, a supporter gifting energy, completing specific task on any ODKay platform, or any other specified way that is advertised by ODKay themself via, ODKay website, ad, etc.All energy sales are final. Once purchased, the energy is yours to keep. However, if your account is inactive for a period of consecutive days. ODKay will deduct 10 energy a day for a period of 90 days. After 90 days, the account will be terminated and all energy withheld on the account will be gone. There are no refunds for energy.

Section IV (Order Process and Troubleshooting)
For every order, ODKay has a specific and set process.
1. Once the order is received, the order will be looked over thoroughly and will be assessed by cost and amount of time needed to complete the order.
2. The order will then be considered by ODKay staff to be completed within the company. If there is no availability within the company, the order will then be sent to the corresponding company/studio, according to specific contract agreements.
3. If neither of the two above options are available, due to any reason, ODKay will use trusted freelancers via FIVERR.
If there are multiple or duplicate orders for a service made by the same customer, the customer should be contacted immediately via their preferred contact method. There is no reason that the order should be automatically deleted without first communicating with the customer.
Once an order is submitted, the customer has 24 hours to cancel their order for any reason for a full refund. After 24 hours, if their order has not been completed, the customer may still request to cancel their order. However, the order cannot be refunded once it has been completed.
If there is a problem with the order. ex. the customer want’s something changed or is not satisfied with their product, the above will apply.
If a third party (ex. Studio, Fiverr freelancer, etc.) is taking too long, ODKay will reach out to them to touch base and try to get an estimate of how much longer/ how much more work is left. After 7 days, and contact with the third party has been established, the customer should receive their product. If the customer has not received their product, the customer must be contacted to inform them of the delay and what ODKay is going to do to prevent and fix the delay going forwards. Each situation will vary, so each situation will have a different resolution. After the 7 days and no final product being delivered, the process should start over again. (SEE Section IV “Order Process and Troubleshooting” rule number 1.)
Section V (ODKay Policies)
1. Who can use ODKay
When people stand behind their opinions and actions, our community is safer and more accountable. For this reason, you must:
Use the same name that you use in everyday life.
Provide accurate information about yourself.
Create only one account (your own) and use your timeline for personal purposes.
Not share your password, give access to your ODKay account to others, or transfer your account to anyone else (without our permission).
We try to make ODKay broadly available to everyone, but you cannot use ODKay if:
You are under 13 years old.
You are a convicted sex offender.
We’ve previously disabled your account for violations of our Terms or Policies.
You are prohibited from receiving our products, services, or software under applicable laws.
2. What you can or cannot do on ODKay
You may not do anything that directly or indirectly violates our Terms or Polices.
Using ODKay or its services in any way that would be considered unlawful, misleading, discriminatory or fraudulent.
You may not use our services to violate someone else’s rights, including their intellectual property rights.
You may not upload viruses or malicious code or do anything that could disable, overburden, or impair the proper working or appearance of ODKay or anything associated with ODKay.
You may not access or collect data from anything associated with ODKay using automated means (without our prior permission) or attempt to access data you do not have permission to access.
If any of the following are breached or anything mentioned is attempted, ODKay has the right to disable, suspend, and/or terminate the account(s) that have breached or attempted any Terms or Policies. If we disable, suspend, or terminate your account, you will be notified by ODKay staff on what was breached and why we chose the actions we did. In minor cases of ex. Hateful, racial, or any other post that you make on our site that could be considered illegal, we may choose to delete the post. If a post is deleted, you will be informed by our staff as to what was considered inappropriate and why we chose to remove the post.
Section VI (Other Policies)
1.Updating our Terms
We work constantly to improve our services and develop new features to make our Products better for you and our community. As a result, we may need to update these Terms from time to time to accurately reflect our services and practices. Unless otherwise required by law, we will notify you before we make changes to these Terms and give you an opportunity to review them before they go into effect. Once any updated Terms are in effect, you will be bound by them if you continue to use our Products.
We hope that you will continue using our Products, but if you do not agree to our updated Terms and no longer want to be a part of the Facebook community, you can delete your account at any time.
2. Account suspension or termination
We want ODKay to be a place where people feel welcome and safe to express themselves and share their thoughts and ideas.
If we determine that you have clearly, seriously or repeatedly breached our Terms or Policies, including in particular our Community Standards, we may suspend or permanently disable access to your account. We may also suspend or disable your account if you repeatedly infringe other people’s intellectual property rights or where we are required to do so for legal reasons.
Where we take such action, we’ll let you know and explain any options you have to request a review, unless doing so may expose us or others to legal liability; harm our community of users; compromise or interfere with the integrity or operation of any of our services, systems or Products; or where we are restricted due to technical limitations; or where we are prohibited from doing so for legal reasons.

If you delete or we disable your account, these Terms shall terminate as an agreement between you and us, but the following provisions will remain in place
What personal data we collect and why we collect it
When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.
If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.
If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you request a password reset, your IP address will be included in the reset email.
How long we retain your data
If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.
For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.
